Terms of Service
These Terms of Service (“Terms”) govern your use of Mentalis: Draft Sense (the “Service”), operated by Mentalis AI, LLC (“we,” “us”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
1. What the Service is
Mentalis: Draft Sense is a desktop overlay for Magic: The Gathering Arena that watches your Arena log file, recognizes draft events, and provides recommended picks and deck-building suggestions generated by our machine-learning model. We offer free-tier and paid subscription access.
Important — independence from Wizards of the Coast: Mentalis: Draft Sense is unofficial and not affiliated with, endorsed, sponsored, or approved by Wizards of the Coast LLC. Magic: The Gathering, MTG Arena, and related marks are trademarks of Wizards of the Coast LLC. We use those marks only as nominative fair use to describe what the Service works with. See §8 for our Fan Content position.
2. Eligibility and account
- You must be at least 13 years old (16 in the EU) to use the Service.
- You must provide a valid email address and keep your account information current.
- You’re responsible for keeping your sign-in credentials secure and for activity under your account.
- One account per person. Don’t share accounts or credentials.
3. Subscription, billing, and refunds
- The Service offers a free tier (capped at a daily number of pick recommendations) and paid subscription tiers (“Pro Monthly,” “Pro Annual”). Current pricing is shown on the account page; we may change pricing for future billing periods with at least 30 days’ notice.
- Subscriptions auto-renew at the end of each billing period (monthly or annual) until you cancel.
- You can cancel anytime from the Stripe Customer Portal linked on your account page. Cancellation takes effect at the end of the current paid period; you keep access until then.
- Refunds: if you cancel within 7 days of your first paid subscription and have not used the Service substantively during that period, email support@mentalisai.com and we will refund your most recent payment. After 7 days, fees are non-refundable except where required by law.
- EU/UK customers: the 14-day statutory right of withdrawal applies to your purchase. You can exercise it by emailing us within 14 days of your first paid subscription.
- Applicable sales tax is calculated and added at checkout via Stripe Tax.
4. Acceptable use
You agree not to:
- Use the Service to violate Wizards of the Coast’s Terms of Service or Code of Conduct for MTG Arena
- Reverse-engineer, decompile, or attempt to extract the model weights or any other proprietary component
- Resell, sublicense, or commercially redistribute the Service or its output
- Use the Service to harass other players or facilitate cheating in any non-draft Arena format
- Attempt to bypass the free-tier quota, account requirements, or any other access controls
- Use the Service in any way that disrupts our infrastructure (e.g., scripted abuse, distributed scraping)
5. Service availability and changes
- We aim for high availability but make no uptime guarantee. The Service may be unavailable for maintenance, upstream issues (Arena, Stripe, our hosts), or unforeseen events.
- We may add, change, or remove features. We won’t remove paid-tier features mid-billing-period without offering a refund or replacement.
- We may discontinue the Service entirely with at least 30 days’ notice; if we do, we will pro-rate refunds for any unused paid time.
6. Recommendations are advice, not guarantees
The Service produces recommendations— informed guesses by a statistical model. Following them does not guarantee you will win a draft, complete a deck, or hit any particular win rate. You’re the one playing the game; you make the final pick.
7. Your data
How we collect, use, and protect your data is described in our Privacy Policy. The most important pieces:
- You control what we log. Gameplay data collection is off by default; toggle it on your account page.
- Your card details are handled by Stripe. We never see them.
- You can delete your account and data by emailing support@mentalisai.com.
8. Intellectual property, fan content, and third-party data
Our IP
The Service software, model weights, and brand belong to Mentalis AI, LLC. You get a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during an active subscription or under the free tier.
Wizards of the Coast fan content
Magic: The Gathering card data, names, mana symbols, and game mechanics are the property of Wizards of the Coast LLC. We display them under the Wizards of the Coast Fan Content Policy as a non-commercial reference necessary to describe what the Service does. Mentalis: Draft Sense is unofficial fan content permitted under the Fan Content Policy and is not approved or endorsed by Wizards of the Coast. Card images (if any) and oracle text remain the property of Wizards of the Coast.
17Lands data attribution
Our models are trained in part on publicly available Magic: The Gathering Arena draft and game data published by 17Lands (www.17lands.com), licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0). 17Lands has not endorsed Mentalis: Draft Sense. We use the data for training and validation of our recommendation models; our use modifies the data by filtering, aggregating, and combining it with other sources (notably Scryfall card data) for model training purposes. The original datasets are available from 17Lands at the link above.
9. Termination
You may terminate your account at any time via the account page or by emailing us. We may suspend or terminate your account for material violation of these Terms (especially §4), for non-payment, or if continuing to provide the Service to you would put us in legal jeopardy. Where reasonable, we’ll give you notice and a chance to cure first.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or produce any particular result. Some jurisdictions don’t allow the disclaimer of certain warranties; if you live in one, this disclaimer applies to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, Mentalis AI, LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from your use of the Service. Our total liability for any claim related to the Service will not exceed the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim and (b) $50 USD.
12. Indemnification
You agree to indemnify and hold Mentalis AI, LLC harmless from third-party claims arising out of your violation of these Terms or your misuse of the Service (e.g., using the Service to violate WotC’s TOS).
13. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Hamilton County, Tennessee, and you consent to jurisdiction there. If you live in the EU/UK or another jurisdiction with mandatory consumer protections, those rights still apply.
14. Changes to these Terms
We may update these Terms. If we make a material change, we’ll notify signed-in users via email and post a notice on the site at least 30 days before the change takes effect. Continuing to use the Service after the change means you accept the new Terms.
